Terms for VibeAssure’s one-time customer-journey QA service.

1. Provider, acceptance, and jurisdiction
VibeAssure is the trading name of the service provider identified on your order confirmation or invoice (“VibeAssure”, “we”, “us”). The service is operated from Jamaica. These Terms and the laws of Jamaica govern each order, without regard to conflict-of-law rules, and the courts of Jamaica have exclusive jurisdiction unless mandatory consumer law requires otherwise.
By creating an account or placing an order, you agree to these Terms and confirm that you can bind the customer named in the order.
2. The service and order scope
VibeAssure provides a one-time, manually performed quality-assurance review of agreed customer journeys. The order, package description, and confirmed scope state the journeys, roles, environment, and delivery target.
A journey is a connected sequence toward one customer outcome. Scope is limited by the selected package and review window. Testing is a sample-based assessment, not a certification, security audit, compliance audit, or guarantee of launch success.
3. Payment, cancellation, and refunds
Package fees are charged once, in advance, in the currency shown at checkout. There are no subscription renewals. Taxes may be added where required.
You may cancel before we confirm scope and begin work for a refund, less any non-refundable payment-processing charges permitted by law. After work begins, fees are non-refundable because testing capacity has been reserved and performed. If we cannot deliver the agreed service, we may reschedule, narrow the scope with your approval, or refund the affected portion. Statutory refund rights remain unaffected.
4. Customer access and responsibilities
- You must provide accurate scope details, authorized test accounts, working links or builds, required roles, and safe test data.
- Use dedicated credentials and sandbox payment methods; do not provide personal passwords, live card data, or unnecessary personal information.
- You authorize us to access and test only the systems and accounts you identify.
- You are responsible for backups, permissions, third-party terms, and promptly resolving blocked access.
5. Supported environments and third parties
Standard reviews may cover current web, mobile, desktop, or API environments expressly confirmed in scope. Device, browser, operating-system, payment-provider, and identity-provider coverage is limited to what is agreed and safely accessible. Third-party payment or authentication testing may require sandbox access and is excluded where unsafe, prohibited, unavailable, or too complex for the selected package.
6. Delivery and delays
Flow targets delivery within two business days and Launch within three business days after scope, access, and payment are confirmed. These are targets, not guaranteed deadlines. The clock pauses while access, information, builds, or third-party services are unavailable. We will notify you of a material delay and provide a revised estimate.
7. Retests
Launch includes one retest of the original confirmed findings when requested within 14 days of report delivery and when fixes are available in the agreed environment. A retest verifies those findings once; it is not a new full review. New, changed, or unrelated findings may be noted but require a separate booking. Flow retests and additional retests may be purchased separately.
8. Reports, ownership, and confidentiality
You keep ownership of your product, credentials, content, and project data. After full payment, you may use the delivered report for your internal business purposes. VibeAssure retains its pre-existing methods, templates, software, know-how, and branding.
Each party will protect non-public information received from the other and use it only to perform or receive the service. We may use service providers under confidentiality and data-protection obligations. This duty does not cover information already public, independently developed, lawfully received, or required to be disclosed by law.
9. No exhaustive defect guarantee
Testing is time- and scope-limited. We do not promise that every defect, security issue, compatibility problem, or business risk will be found, that reported fixes will resolve every issue, or that a product is defect-free or ready for release. Release decisions remain the customer’s responsibility.
10. Disclaimers and liability
To the fullest extent permitted by law, services and reports are provided “as is”. We exclude implied warranties that may legally be excluded. VibeAssure is not liable for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, data, goodwill, or launch opportunity.
Our aggregate liability arising from an order will not exceed the amount paid for that order. These limits do not apply where liability cannot legally be limited, including fraud or wilful misconduct.
11. Suspension, termination, and changes
We may pause or end work for unlawful use, unsafe testing, non-payment, material breach, or risk to people or systems. You may stop using your account at any time; payment and work already performed remain subject to section 3. We may update these Terms prospectively and will post the new effective date.
